First Women As Chief Justice of India

There is great news that which can be the historic moment that Justice B.V. Nagarathna is going to become the first woman Chief Justice of India, She will become part of the Supreme Court Collegium from May 25,  as Abhay S. Oka current justice who is  one of the existing members of the Collegium, is demitting his post today.

Let us explain to you about the  Collegium, which  basically comprises the five senior-most judges of the Supreme Court, who play an important role for appointing judges to the Supreme Court as well as deciding on the transfer of High Court judges. The three senior-most judges decide on the appointment of judges to the High Courts.

From the time when CJI Gavai’s term began, the Collegium comprised Justices Abhay S. Oka,Surya Kant,Vikram Nath and J.K. Maheshwari.

As Justice Oka is getting retirement  from his post today on May 24, so there was seat vacated the Collegium.

So CJI and Collegium have decided that fifth senior judge will be  Justice Nagarathna, and she will officially become part of the Collegium from tomorrow and will remain part of it till she retires as the Chief Justice of India in 2027.

55th Chief Justice of India

She is the 55th Chief Justice of India and became the first woman as Chief justice. She will work only 36 days from sep 24 to October 29 2027 which will count as third shortest tenure of a chief justice .

If we talk about the career of  Justice Nagarathna, she started practising law in 1987 with Kesvi & Co, Advocates. In the year  1994, she started independent practice focusing on constitutional, commercial, administrative, and family laws. In February 2008, she was appointed as an Additional Judge of the Karnataka High Court and was made permanent in 2010. She was elevated to the Supreme Court on August 31, 2021. As a Supreme Court judge, she has been part of several constitution bench judgements and has given strong dissenting opinions in many of them, such as cases relating to royalty payable by mining operators to the Centre, power of states to levy tax on industrial liquor, etc. One important fact about justice Nagarathna is that she was the only justice who said RBI did not take proper decisions while demonitization.
